Terms and Conditions
ORDERING
o FACTORY V PROHIBITS ALL PRODUCTS TO BE SOLD VIA INTERNET SITES AND WILL TERMINATE ANY ACCOUNT SELLING PRODUCT ONLINE WITHOUT WRITTEN AUTHORIZATION.
o FACTORY V determines the channels of distribution and reserves the right to refuse to supply product to any account in its sole discretion
o All wholesale orders are to adhere to both the $500 and quantity minimums
o Once order is placed, no changes are permitted
SHIPPING & HANDLING
o Shipping costs are estimated and quoted based on calculated item weight and location
o No terms or COD orders
o Shipping prices vary by delivery method and can be chosen at checkout and payed by customer
o SHIPPING METHOD DOES NOT INCLUDE PROCESSING TIMES
PRICES
o Current prices are listed on ordering sheet and are subject to change without notice
o All merchandise must be sold at manufacturers suggested retail price [MSRP]
o Discounts are permitted up to 20% off, unless included in storewide sale and approved by FACTORY V
RESTRICTION OF SALE
o Customer is prohibited from selling FACTORY V products other than through FACTORY V approved channel of distribution. Violation of this condition will result in immediate termination of account
CLAIMS
o All merchandise shortages, overages or damages must be reported to Hell Babes via email within 5 days of merchandise delivery. Customer must provide all necessary information including order number, product quantity, size & detailed description of the issue. Damage claims must include pictures of item(s)
DEFECTIVE MERCHANDISE
o All defective merchandise must be reported to FACTORY V via email within 5 days of merchandise delivery. Defective merchandise refunds will be handled on a case-by-case basis at FACTORY V sole discretion
LIMITATION OF LIABIITY
o Under no circumstance shall FACTORY V be liable to the customer for any profit loss, interruption of business or any special, indirect, consequential or incidental damages arising in contract (including breach of warranty), in tort (including strict liability or negligence), or otherwise.
FORCE MAJEURE
o FACTORY V shall not be liable for any failure or delay in delivery or in its performance under these terms and conditions or otherwise due to any cause beyond FACTORY V reasonable control, including, without limitation, any fire, explosion, earthquake, flood, riot, sabotage, industry-wide strikes, lockouts, labor difficulties, supplier failures, unavailability or shortage of materials. Where any product scheduled for delivery becomes unavailable as a result of a force majeure event, FACTORY V may, at its sole discretion, substitute such product with a comparable product.
RETURN POLICY
o No returns or exchanges permitted at any time
GENERAL
o All purchases and sales from FACTORY V products to customer shall be made solely on these terms and conditions and shall be applicable in full to all such purchases and sales. Any modification, supplement, or amendment of these terms and conditions shall be made in writing by FACTORY V authorized management representative only.
